Although they seem to have been around forever, Biro didn't file his patent until 1938 in Paris and 1943 in the U.S.A.. Following the U.S. patent it was quickly licensed for UK production for the RAF who found the new biros worked much better at altitude than fountain pens. In 1965, Italian Marcel Bich bought the patent from Biro and started making Bic ballpoint pens. Sheaffer was an American who patented the lever filling fountain pen and Petroczy was a Hungarian helicopter pioneer.

Bíró sold his patent rights to Marcel Bich, who produced the ubiquitous Bic pen, sometimes called the Bic Biro.
