Addison broke the pact when she slept with Alex in the episode entitled "Desire." Mark saw Addison and Alex coming out of the on-call room after their tryst and Mark decided to do the right thing and let Addison go. On Meredith's advice Mark lies to Addison and says that he broke the pact, allowing her not to feel guilty.
