Race is a big one to avoid. It's best to not refer to any aspect of your applicant's race, including racial stereotypes and cultural beliefs. Additionally, unless the ability to read and write a foreign language is critical to the job, you cannot ask about any applicant's mother tongue.

Answer: Are you able to lift a 50 lb box off of a five foot tall shelf?

Height, weight and gender should have no impact in your hiring decision so long as the applicant is able to handle the physical requirements of the workplace. It's best to keep your questions focused on the specific tasks necessary to perform the job rather than second guessing an applicant based on their size.

If the job requires a certain "look" then it is OK to request a photo. However, outside of acting and modeling jobs there are very few positions where your looks are crucial to your performance! If it doesn't affect the job, then discriminating against someone based on their appearance is against the law.
