The freedom of worship is given two ways, by prohibiting the establishment of an "official" religion and by protecting the free exercise of religious practice.

Many people think that this is in the 5th Amendment, but it's actually at the very start of the 6th.
3. This Amendment specifically states that "the enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."

Because of the nature of this amendment, it wasn't cited extensively until it was used in conjunction with other amendments to create a right to privacy in the 1965 case of Griswold v. Connecticut, which dealt with the issue of state laws banning the distribution of contraceptives.

There have been a couple of cases where the High Court has foreclosed the option of suing states to pursue relief for violations of federal law. The most notable recent case is Alabama v. Garrett (2001).
