II. RESTRICTIONS, DISCLAIMERS AND RESERVATION OF RIGHTS
A. Religious Restrictions: A Catholic cemetery is intended for, and restricted to, the interment of Catholics and their family members who are entitled to such interment in accordance with applicable Canon Law and discipline of the Roman Catholic Church. The CCA will make every effort to avoid breaking familial connections, therefore non-Catholic members of Catholic families may be interred in a Catholic cemetery. All determinations with regard to the Right of Interment shall be within the sole discretion of the CCA and the burden of proving that the deceased is Catholic, a relative entitled to interment in a CCA cemetery or otherwise entitled to interment, shall rest with the owner of the Right of Interment or person applying for the interment of the deceased.
B. Burial of Non-Catholic Christian, Non-Christians and Catechumens: Though catechumens are not yet baptized as Catholics, they are members of the household of the Church and are entitled to the full rite of Christian burial at a Catholic cemetery. Canon 1183 §1 of the Code of Canon Law. In the prudent judgment of the local Ordinary, ecclesiastical funeral rites can be granted to baptized members of a non-Catholic Church or ecclesiastical community, unless it is evidently contrary to their will, and provided their own minister is unavailable. Ownership of a right of interment in a CCA cemetery is restricted to individuals of the Roman Catholic faith, with the exception that the non-Catholic family member may enter into an Agreement with the CCA for the purchase of a right of interment for the interment of a Catholic family member and for themselves
