Although most agreements allow for interest to add to the debt, many collection agencies will settle for a lower balance in certain situations.

While the FDCPA does allow a collector to discuss the information with a spouse, there are three states that have passed legislation to prohibit speaking with the spouse. The states are Alabama, Iowa and Massachusetts.

An inconvenient time is also defined by the FDCPA as any time the consumer tells us it is an inconvenient time.

Most states allow a collector to give any name they wish, meaning I can say I am "Krusty the Clown". However, there are some states that require all alias names to be registered with the state.

While a collector is not allowed to voluntarily tell someone on the phone about the existence of a debt, if asked, they are allowed to say the name of the collection agency.

Answer: True

Even in mail communications, a debt collector is not allowed to notify others of the existence of the debt. By sending a postcard, any person handling the mail could see the information.
