Quiz Answer Key and Fun Facts
1. Under what circumstances can a collection agency add interest to a debt?

Answer: If state law and the agreement creating the debt allow it

Although most agreements allow for interest to add to the debt, many collection agencies will settle for a lower balance in certain situations.
2. According to the FDCPA, a debt collector may discuss the debt with which one of the following?

Answer: The consumer's spouse

While the FDCPA does allow a collector to discuss the information with a spouse, there are three states that have passed legislation to prohibit speaking with the spouse. The states are Alabama, Iowa and Massachusetts.
3. In which of the following states is the solicitation of post dated checks not allowed?

Answer: Massachusetts

While a debt collector can not solicit a post dated check in Massachusetts, they can accept them, if the consumer wants to set them up.
4. Who has the legal standing to sue a debt collector for alleged violations of the FDCPA?

Answer: all answers are correct

Not only can anyone sue the collection agency, they can sue the collector who violated the laws directly.
5. A consumer tells a collector that he won't pay the bill and to stop calling. Under the FDCPA, the collection agency can still mail collection notices.

Answer: True

In order for all communications to stop from a debt collector, the FDCPA states that a written request must be sent to the collection agency.
6. According to the FDCPA when can a collector assume to be a convenient time for communicating with a consumer?

Answer: after 8:00 AM but before 9:00 PM, where the consumer is located

An inconvenient time is also defined by the FDCPA as any time the consumer tells us it is an inconvenient time.
7. In which of the following states are the use of alias names by collectors prohibited?

Answer: North Carolina

Most states allow a collector to give any name they wish, meaning I can say I am "Krusty the Clown". However, there are some states that require all alias names to be registered with the state.
8. A collector must reveal in every call with a debtor that that the call could be monitored or recorded for compliance purposes and that the call is from a debt collector.

Answer: True

The purpose of a collector giving these statements is to ensure that the debtor is informed of the purpose of the call. It is similar to the Miranda rights given to someone as they are getting arrested.
9. When attempting to locate a debtor, a collector is asked who they represent. How should they respond?

Answer: "I work for ABC Collection Company"

While a collector is not allowed to voluntarily tell someone on the phone about the existence of a debt, if asked, they are allowed to say the name of the collection agency.
10. The FDCPA prohibits a debt collector from sending a collection notice to a debtor by postcard.

Answer: True

Even in mail communications, a debt collector is not allowed to notify others of the existence of the debt. By sending a postcard, any person handling the mail could see the information.
