The Legal situation in the UK with regard to children's schooling is summed up by the phrase, "Education is compulsory, schooling is not".

If your child has never been registered at a school, you are not legally required to notify anyone when you decide to home school.

Answer: The School

If your child has been registered at a school, you are legally required to notify the school. You must write a formal letter telling the school to de-register your child. The school must comply with your request within a legally specified time limit of two days. You do not have to notify anyone else at all.

The school will notify the LEA, but as a parent, you only have to tell the school.

You are not obliged to allow the LEA into your home, or to speak with your child. You do have to show that the child is receiving a "suitable full time" education, but how you do so is up to you. Obviously co-operation with the LEA can make life easier, but it is not a legal requirement.

Answer: You don't

You don't have to follow provisions in a statement of special needs when educating at home. As long as you fulfill the legal requirement to provide a "suitable full time education" for your child, you are entitled to home educate any child.

Answer: False

A child can return to school of their own accord, although you do have to find a school that will give them a place. The LEA are obliged to find a place for a child at a school. Also, the LEA can obtain a court order to force a child to return to school if they can show that the child is not receiving a "suitable education" at home.

The onus is on the parent to show that their child is receiving education at home, by various methods, chosen by the parent, such as written work from their child.
10. In England, how many hours a week constitute a "full time education"?

Answer: 12 hours

It is just 12 hours a week. This seems a very short time, but if you consider how many hours of a school day are actually spent being taught, and how many teaching hours a week are dedicated to a particular subject, it is in fact a realistic minimum number. There is no limit on the maximum hours you can teach of course, while a child is doing anything they are learning something.
