Quiz Answer Key and Fun Facts
1. How many EU/EEA member states must an MNC be operating in before it is subject to the EWCD?

Answer: Two

It must have at least 150 employees in each of at least two member states to be covered by the legislation.
2. How many employees must a company have working in the EU/EEA before it is subject to the Directive?

Answer: 1000

The ETUC has asked the EU to reduce this criterion to 500.
3. What does a European works council (EWC) have a legal right to expect from central management of the company before it makes a major decision affecting workers?

Answer: timely information and consultation

Renault were successfully taken to court for failing to inform and consult their EWC of redundancies in Belgium.
4. Roughly, how many companies were covered by the EWCD in 2001?

Answer: 1800

This may have increased a bit now as more countries joined the EU in 2004, on the other hand, mergers and aquisitions keep the number down.
5. What percentage of those companies had already got a European Works council?

Answer: 35-45%

In fact, only about 36% of covered companies had complied with the Directive in 2001. The smaller the company is, the more likely it is to be ovoiding its obligations.
6. So, when did the EWCD first become law?

Answer: 1994

Directive 94/45/EC - it was later applied to the UK (97/74/EC) after it dropped its opt-out from EU social legislation.
7. And when did the first EWC come into existence?

Answer: 1985

The French company, Thomson Consumer Electronics, set up an experimental 'European Committee' to carry out social dialogue at the European level in October 7, 1985. It was to be the first EWC.
8. The intellectual history of the EWC can be traced back as far as 1959 with the ideas of Thibièrge and Sanders. But what piece of European legislation is even more directly traceable to their concerns?

Answer: The SE Directive / European Company Statute

Although both sides of industry found clear advantages in an EU regulation defining a European Company Statute, including workers' participation rights, it took more than 30 years to get this proposal adopted.
9. The directive distinguishes between agreements made before a specified cut-off date(which were free to have any agreed content) and after that date (which had to abide by certain criteria). What names are commonly given to these two different kinds of EWC agreement?

Answer: 'article 13' and 'article 6'

The UK got a bit longer to allow article 13 agreements once they ratified the directive in 1997.
10. Roughly how many workers are represented in EWCs?

Answer: 10 million

That is 62% of the total number of employees working in covered companies.
