Quiz Answer Key and Fun Facts
1. File this under the "Incredibly Criminally Inane": When a man accidentally sliced off the tip of his thumb, a fast thinking and scheming co-worker asked if he could buy the half phalanx for the sum of $100.00. Which fast food restaurant chain suffered a slice in revenue when the body part was discovered in a bowl of chili the schemer's wife was enjoying?

Answer: Wendy's

The L.A. Times reported evidence that the digit found in the chili at Wendy's "was not consistent with an object that had been cooked in chili at 170 degrees for three hours, as is the Wendy's policy." The evidence shifted, and fingers were pointing towards the woman.

Further investigation found that the couple had filed previous lawsuits against 10 other major corporations. When the owner of the finger came forward, he admitted he had sold the stub six months earlier as payoff to a debt owed and that he had no knowledge of his co-workers pointless plan.

The couple that defrauded Wendy's were sentenced to between 9 and 12 years in prison.
2. What incredibly well-known TV personality faced a lawsuit brought on behalf of the Texas cattle producers, who whined foul, for what they believed to be disparaging remarks about the cattle industry?

Answer: Oprah Winfrey

In the mid 1990's, Oprah Winfrey and her guest, Howard Lyman, were discussing the recent outbreak of Mad Cow Disease in Britain. Oprah made the remark "just stopped me cold from eating another burger". The Texas cattle producers sued Oprah under a 1995 law that says people may be sued for making false or disparaging remarks about perishable food products.

The lawsuit was eventually dismissed with prejudice.
3. Customers aren't the only ones unhappy with restaurants. In January 2010, an Arizona eatery called Heart Attack Grill sued the Florida based Heart Stoppers Sports Grill. What was the reason behind the lawsuit?

Answer: A stolen idea for a medically themed high calorie restaurant

In a battle of the greasy grills, Heart Attack Grill slapped Heart Stoppers Sports Grill with a lawsuit claiming they stole their medically themed restaurant idea. Heart Attack Grill asserts that there are about thirty similarities between the two restaurants, including free meals to customers weighing over 350 lbs. Heart Stoppers Sports Grill argues that their theme is not the same. They offer a different menu, a hospital-like setting and promote a family dining atmosphere. Lawsuits aside, both restaurants cater to people unafraid to overeat. 8000 calorie hamburger anyone?
4. A customer at which sandwich shop whined when he got a surprise by finding a knife baked into the bread of his sandwich?

Answer: Subway

After taking a bite of his Subway sandwich 27-year-old New Yorker John Agnesini was surprised to find a 7-inch knife baked inside the bread. Luckily he was not injured, nor did he ingest any part of the knife.

He did sue Subway for $1,000,000 when he became sick to his stomach. He claimed the plastic handle of the knife, which is the part he bit into, was highly unsanitary and made him sick for three hours with food poisoning.
5. If you dined at this Iron Chef's Manhattan eateries you may have encountered some whiny workers. Which celebrity chef, most famous for Southwestern cuisine, was sued by restaurant employees for labour and wage violations?

Answer: Bobby Flay

Denying any misconduct, Food Network mainstay Bobby Flay settled out of court by paying $800,000 to workers who claimed they were cheated out of wages and tips. Employees from Flay's Bar American, Mesa Grill and Bolo restaurants complained they were forced to buy and launder their own uniforms and were not given a share of the tips charged to private-party tabs.
6. Customers and restaurants are not the only ones who whine about the food industry. In 1993, a certain fast food restaurant chain was guilty of serving hamburgers tainted with "E. coli". The incident resulted in the deaths of four children in the Seattle area. When the dust settled, customers sued the restaurant chain. The restaurant chain sued its suppliers. The suppliers sued their suppliers. The USDA, which was tasked with inspecting procedures in the slaughterhouses, blamed food industry lobbyists. Which restaurant chain was the "victim" of this horrible incident?

Answer: Jack in the Box

Hundreds more became sick due to beef contaminated with "unacceptable" levels of fecal matter. It begs the question, "what is the acceptable level of fecal matter in your food?"
7. A Tulare, California woman, Fernanda Cruz, would visit the nearby Sizzlers Restaurant twice a week where she always had a bowl of their New England Clam Chowder. What do you think she whined about finding in her soup January 10, 2001?

Answer: A condom

Fernanda Cruz sued Sizzlers International for emotional distress when she found a condom in her beloved clam chowder. She claimed to have found it and another one in her bowl of soup, and said more were found in the pot in the kitchen. She refused the $4,000 Sizzlers offered her.

A court appointed psychiatrist reported that she may have made the story up and that she suffered no more than an inability to eat certain foods. The suit was dismissed.
8. The National Franchise Association sued Burger King over their $1 Double Cheeseburger deal on behalf of which fast food company's whining franchise owners?

Answer: Burger King's

The issue Burger King's own franchises had with the $1 Double Cheeseburger deal was that it cost more then $1 to make the Double Cheeseburgers. The average cost of making a Double Cheeseburger is between $1.10 and $1.15, depending on cost of rent and workers salaries.

They sued for the right for the individual franchise owners to set their own pricing, rather then have Burger King set them. Burger King's logic is that consumers will make up the difference by buying other items with higher profit margins, which include drinks and French fries.

In March the court ruled against the franchise owners.
9. In 2004 which of the following countries had a legislative body pass a bill making it illegal for obese plaintiffs to whine and then sue fast food restaurants for contributing to making them obese?

Answer: United States

This bill was accepted by the House of Representatives, but never acted upon by the second legislative body, the U.S. Senate, therefore never went into effect. If the Senate had also passed the bill, then all it would have needed was the President's signature.
10. In 2010 which New Orleans chef whined his/her way to court and filed a lawsuit against BP, following the Deepwater Horizon oil rig disaster and subsequent long term oil spillage into the Gulf of Mexico?

Answer: Susan Spicer

In June, 2010, renowned chef Susan Spicer filed a class-action lawsuit against BP on behalf of her restaurant, Bayona, and others similarly affected. The claim filed states that the restaurants depend heavily on a normal supply of seafood that can no longer be met, thereby adversely and detrimentally affecting their operations and their ability to perform their occupations.
