Miguel and his girlfriend severely beat an elderly man after he accidentally scratches Miguel's car. He is also charged with criminal mischief in the second degree. Although he is given a 15 year sentence, he will be up for parole in just two years.

Miguel is stabbed before he can even be taken to his cell. We see much of the first episode through the eyes of Tobias Beecher and this attack is the first of many terrifying events in the prison. Miguel ends up spending his first few weeks in the hospital wing before finally making it to Emerald City.

The baby does eventually die, triggering a kind of breakdown for Miguel. Convinced that his pride had somehow caused God to punish him by taking away his baby, Miguel cuts his own face, leaving a huge scar.

Miguel, as leader of the Latino inmates in Emerald City, is given a main responsibility during the riot and asks to be allowed to be in charge of the hostages. He tries to get medical help for the injured hostages, but his request is refused by the other leaders of the riot.

Miguel's water bottle is spiked by Ryan O'Reilly in a plot to fix the outcome of the tournament to favour his brother, Cyril. The drugged Miguel cannot beat Jason Cramer and ends up losing the battle. This leads to him losing even more credibility, as he is beaten by an openly gay man, and the Latinos are not happy at this dent to their reputation.

Busmalis is caught fairly soon after his escape but Miguel manages to keep his head down for quite some time. This escape was written into the story because the actor playing Miguel, Kirk Acevedo, had a commitment to another television programme. Miguel is eventually caught trying to cross over into Mexico. On his return to Oz, he tells Warden Glynn that he was going to travel through South America to a place nicknamed "The End of the Earth".

He asks if Glynn would have been willing to follow him that far and Glynn admits that he probably wouldn't.

Vasquez, a friend of Guerra, attacks Miguel, who retaliates by cutting Vasquez's throat. Miguel is sent back to solitary for the remainder of season 4.

Guerra goes against their agreement though, and stabs Miguel in the chest, narrowly missing his heart. Miguel's actions impress young Latino inmate Jaime Velez, who asks to be Miguel's lieutenant. Miguel orders Velez to kill Guerra but the attempt backfires and Velez ends up dead, a fact which weighs heavily on Miguel's conscience.

Miguel signs up for the guide dog program in an attempt to make up for blinding Eugene Rivera. Despite being specifically told not to teach the dogs anything additional, Miguel taught his dog to obey all the commands in Spanish as well as English, based on the assumption that the Rivera family spoke Spanish at home.

Although he went against the strict rules, Alicia was very impressed with this initiative.

Miguel meets with Wolfgang's widow, Cathy Jo, who also has no idea why Wolfgang has left everything to Miguel. After learning from Ruiz that he will never make parole, Miguel becomes completely depressed and hopeless and it is implied that he gives into Torquemada's advances.
