This episode of "The West Wing" opened up in the United States Supreme Court. The court was hearing a case involving the eighth amendment, which prohibits the use of cruel and unusual punishment as well as imposing excessive bail. The issue that the court decided upon was whether to grant a stay on an execution, meaning to delay one's execution.

The court denied the applicant's stay of execution.
